About these terms

Clever Cookie Studios is run by [Company legal name] (company number [Company number]), registered at [Registered address] ("we" or "us"). These terms apply when you use the Clever Cookie app and website. By using them you agree to these terms, so please read them. If you don't agree, please don't use Clever Cookie Studios.

Our privacy notice explains how we handle personal data. Partner organisations who run trails in Clever Trails Studio have a separate agreement with us, which applies to Studio instead of these terms where the two differ.

Nothing in these terms affects your legal rights as a consumer.

Who can use Clever Cookie Studios

Clever Cookie Studios is for families to use together. A parent, carer or other responsible adult (a "grown-up") sets up the app and is responsible for the children using it. Children should only use Clever Cookie Studios with a grown-up who is supervising them.

You must be 18 or over to sign in, leave a review or use the forms on our website.

Staying safe on a trail

Clever Trails is a story to enjoy on a walk. It doesn't replace your own judgement, and the grown-ups in your group are responsible for everyone's safety. In particular:

  • Supervise children at all times, especially near roads, car parks, water, steep ground, livestock, cyclists and horses.
  • Stay on marked paths and public areas. Never go onto private land, or into an area that is closed or fenced off, to reach a stop.
  • Keep your eyes up. The story is designed to be listened to with the phone in a pocket. Stop walking before looking at the screen.
  • Check the weather, daylight, opening times and the route before you set out, and wear suitable clothes and footwear.
  • Follow the site's rules, signs and staff instructions, and the Countryside Code. Don't pick or eat plants, berries or fungi, and don't disturb wildlife.
  • Skip any activity that doesn't feel safe or suitable for your group. You can always move the story on by hand.
  • Stop if conditions change or anyone feels unwell. In an emergency, call 999.

Trail sites and our partners

Trails take place at sites owned or managed by our partner organisations and others, not by us. We don't control the condition of paths, closures, hazards, facilities, parking or admission, and we're not responsible for them. Information we show about a trail, such as its length, terrain and facilities, is a helpful guide and may change. Please check with the site before you travel, and report hazards to the site's staff.

Trail plaques and their tags belong to the site. Please don't move, damage or remove them.

Some sites charge for parking, admission or other things. Those charges are set by the site and aren't part of Clever Cookie Studios.

Location, tags and offline play

GPS can be inaccurate, especially under trees or near buildings, and NFC tags and QR codes can wear. If a stop doesn't unlock, use another way, such as tapping the plaque, scanning its code or moving on by hand. Download a story before you go if reception at the site is poor, and make sure your phone is charged.

Using the app and its content

The app, stories, narration, characters, artwork, badges and other content belong to us, our partner organisations or the people who license them to us. We give you a personal, non-exclusive, non-transferable licence to use the app and its content for your own family's enjoyment, not for commercial purposes, for as long as you follow these terms.

Please don't:

  • copy, share, sell or publish stories, recordings, artwork or badges, except for personal pictures and memories of your walk;
  • try to copy, take apart or interfere with the app, our servers or trail plaques, or get around how stops unlock;
  • collect content from the app or website using automated tools;
  • use Clever Cookie Studios in a way that breaks the law or harms anyone.

The app store you downloaded the app from also has terms that apply, such as Apple's standard licence terms for apps.

Price

The Clever Cookie app is currently free to download and use. If we ever offer something you pay for, we'll show the price and any extra terms clearly before you buy, and your consumer rights for digital content will apply.

Reviews

Reviews help other families choose a walk, so we'd love to hear how yours went. Every review is checked before it's published, by us or by the partner organisation that runs the trail. A review must:

  • be honest and about a visit you made;
  • not include anyone's full name, contact details or other information that identifies them, especially children;
  • not be offensive, hateful, threatening, discriminatory or untrue about a person;
  • not include adverts, links or spam, or be written for or by the organisation running the trail.

We or the partner may decline or remove a review that breaks these rules, or that we reasonably think isn't genuine. Partners may reply publicly to reviews.

When you send a review, you give us and the partner who runs that trail permission to show it, with the name and ages you chose, in the app, on our website and in materials about the trail, free of charge. We won't change what it means. You can ask us to remove your review at any time.

Partner organisations and Clever Trails Studio

Studio is for staff and volunteers of our partner organisations. Its use is governed by the agreement between your organisation and us. In summary, if you use Studio you must:

  • keep your own account to yourself and your sign-in methods secure;
  • only upload content your organisation has the right to use, including permission from anyone who appears in pictures or recordings;
  • keep trail information accurate and up to date, and remain responsible for the safety of your site;
  • moderate and reply to reviews fairly and honestly.

We may suspend Studio access that's being misused.

Availability and changes

We work hard to keep Clever Cookie Studios running, but we can't promise it will always be available or free of faults. We may change, add or remove features and content. Trails can close, move or be withdrawn, for example when a site changes or a partnership ends. Where we reasonably can, we'll let you know about important changes in advance.

Our responsibility to you

We'll provide Clever Cookie Studios with reasonable care and skill, and the app and its content should be as described and of satisfactory quality, as UK consumer law requires. If digital content we provide damages your device or other digital content because we didn't use reasonable care and skill, we'll either repair the damage or compensate you.

We don't exclude or limit our responsibility where it would be unlawful to do so. That includes death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, and your rights under the Consumer Rights Act 2015.

Otherwise, we're not responsible for:

  • loss or damage that wasn't a foreseeable result of us breaking these terms or failing to use reasonable care and skill;
  • the condition of trail sites, or the actions of site operators or other visitors;
  • events outside our reasonable control, such as weather, closures or mobile signal;
  • business losses. Clever Cookie Studios is for domestic and private use.

Stopping or suspending use

You can stop using Clever Cookie Studios at any time. To close a sign-in account, email hello@clevercookiestudios.com. We may suspend or end someone's use of Clever Cookie Studios if they seriously or repeatedly break these terms, for example by posting abusive reviews or tampering with trail plaques or our systems.

Changes to these terms

We may update these terms when Clever Cookie Studios changes or the law requires it, and we'll change the date at the top. If a change is important, we'll tell you in the app or on our website before it takes effect. If you keep using Clever Cookie Studios after that, the new terms apply.

Law and disputes

These terms are governed by the law of England and Wales. If you have a dispute with us, please contact us first so we can try to sort it out. If we can't, you can bring proceedings in the courts of England and Wales, or, if you live in Scotland or Northern Ireland, in your local courts. You keep the protection of any mandatory consumer law where you live.

If a court decides part of these terms can't be enforced, the rest still applies. Only you and we have rights under these terms. We may transfer them to another organisation, and we'll make sure that doesn't reduce your rights.

See you on the trail.
